To Lie or Not to Lie: The Use of Deception During An Interrogation
If the agents involved in the recent Colombia incident are interrogated, should the investigators tell them they have evidence that they don't really have? It depends on a number of considerations.
Earlier this year a case was reported in which a detective doctored a crime lab report to use as a prop during an interrogation. While the suspect did not confess, the detective's tactics spurred legal questions regarding the use of deception during an interrogation. The legal twist was that even though the report used as an interrogation prop was manufactured by the investigator, it was based on factual verbal information provided by the crime lab. In other words, the manufactured evidence contained truthful information that incriminated the suspect but the report was not a bona fide report from the crime lab.
Legal Considerations
The legal test for deceptive practices during an interrogation has remain unchanged for more than 40 years. The use of deception during an interrogation must be considered within the totality of circumstances when deciding the admissibility of a confession. Deception that shocks the conscience of the court or community will generally result in a suppressed confession. An example of deception that "shocks the conscience" is lying to the suspect about the possible consequences he faces, e.g., telling a homicide suspect that the legislature just dropped first degree murder to a misdemeanor. Similarly, an investigator who elicits a confession after falsely telling the suspect that he is his court appointed public defender has "shocked the conscience".

Two recent polygraph examiner mistakes would not have occurred had they attended PEOA refresher training
1. An analog-using examiner (but not a PEOA member) told a TV producer that he could handle their 2 days of televised exams that required a computerized polygraph instrument. Quickly obtaining a computerized instrument and not knowing it well, he fumbled badly. He was dismissed after a few hours on the first day, and was told he wasn't needed. A PEOA-referred examiner finished that first day of exams and also those of the entire second day, and the PEOA examiner's exams were televised.
2. In a recent court case, a polygraph examiner (but not a PEOA member) was found to have not been following Federal polygraph training, instead using words in questions that were not proper to use. Federal training tells of why not to use these words, as they will likely cause false-positive scores.

FullScope Polygraphs are a combination of LifeStyle Polygraphs and CounterIntelligence Polygraphs
These are not to be done by the vast majority of polygraph examiners you can find via the Internet. It involves a lengthy (and originally Federally written) completed application, and the polygraph exam focuses on that application.
A Lifestyle (LS) Polygraph asks the applicant questions that concern the examinees’s personal life and conduct, and can involve all aspects of present and past behavior. Questions asked could concern drug and alcohol use, sexual misconduct, mental health, family relationships, compulsive or addictive behavior, and more. A LifeStyle Polygraph looks for issues in an applicant’s private life for which he or she might be susceptible to blackmail or coercion, and/or whether or not that applicant can be trusted with sensitive information. A very detailed questionaire is involved.
A CI or CounterIntellgence Polygraph asks only questions to determine whether the examinee ever had any involvement with or knowledge of espionage/sabotage/terrorism against the United States, unauthorized contact with representatives of a foreign government, or unauthorized disclosure of classified material. It is sometimes used to determine initial eligibility for a special assignment or special access, and is often administered to persons who already have Top Secret clearances. Usually there are no lifestyle questions included.

Polygraph examination by John Grogan allowed in as evidence by Judge
A polygraph examination administered by polygrapher John Grogan was allowed in as evidence by the judge overseeing the case, despite the objection of the other side to polygraph evidence.
While polygraph exams are often allowed in as evidence by stipulation (when both sides agree in advance), this exam was not agreed to.
Thus the judge had to decide. Grogan was interviewed for a full day by one side's attorney, about not just his 25 years of polygraph experience but also about the polygraph profession & history, in detail. Then the other side's attorney cross-examined Grogan for an entire day, hoping to exclude polygraph evidence.
The judge quickly decided that Grogan was knowledgeable and credible and that polygraph is reliable, and allowed the polygraph report to stand as evidence.
